基层民事检察工作的困境与出路

2013年1月1日,新民事诉讼法实施,进一步完善了民事检察监督制度。2013年11月18日,最高人民检察院颁布实施《人民检察院民事诉讼监督规则（试行）》,进一步规范民事检察监督程序。这些法律、司法解释的相继实施有效推动了民事检察工作的发展,然而,对于基层民事检察工作来说,案源匮乏的问题更加严峻,而权力、队伍等问题依旧存在。本文从案源、权力、队伍三个方面全面探讨了基层民事检察司法实践中存在的困境,并提出了解决困境的出路。

Dilemma and way out of grassroots civil prosecution

The new Civil Procedure Law was implemented on January 1, 2013,which further improve the supervision system of civil prosecution. The Supreme People＇s Procuratorate promulgated the ＂People＇s Procuratorate Supervision Rules of Civil Suits（Trial）＂ on November 18,2013, which further standardize the supervision process of civil prosecution.The implementation of these laws and judicial interpretations has effectively promoted the development of civil procuratorial work, however, for grassroots civil prosecution, the scarcity of case sources is even more serious, and the power, the team and other issues still exist.This article comprehensively discussed the plight in the judicial practice of grassroots civil prosecution from three aspects of the case source, the power and the team, and proposed a way out to solve the dilemma.
