案例教学法在刑法教学中的应用

案例教学法最早是由哈佛大学法学院院长兰代尔于1870年创立,20世纪90年代被引入中国。但是,因为大陆法学和英美法系的区别,加之传统教学模式和教育理念的影响,虽然一直以来这种教学模式也见于各大高校刑法学的课堂,但是还是存在很多误区和问题。文章从案例教学法在刑法教学中的必要性和现在实践中存在的问题出发,探究这种教学方法在刑法学课堂中的具体实践流程和方式,意图使这一教学方法能够更好的发挥它的功能和优势,为我国培养实践型的综合性法律人才。

Application of Case System in Criminal Law teaching

The Case System was first founded by Langdale, Dean of Law School in Harvard University, in 1870, and introduced into China in the 1990 s. But because of the difference between continental law and common law, coupled with the influence of traditional teaching modes and educational philosophy, there is still a lot of errors and problems, even if this teaching mode has been also found in Criminal Law classes in many universities. The article started from the necessity of Case System in Criminal Law teaching and problems that existed in the practice, explored the concrete practice processes and ways of this teaching method in Criminal Law classes, and intended to make this teaching method better play its features and benefits to train practice-based comprehensive legal professionals for China.
