论法律方法的异化及其成因——兼析司法过程中司法资源的市场化配置

司法过程中的法律方法是在司法实践基础上所作的理论总结,而不是单纯地依据法学理论进行的逻辑归纳.笔者对目前法学理论界持有的法律方法必然具有正当属性的观点表示质疑,原创性的提出在具体的司法实践中法律方法的异化问题,并剖析其异化的基本形态及成因.同时,从社会信息经济学的视角论证法律方法的异化现象与司法资源交易行为的辩证关系,指出二者的相互依存、相互转化、相互促进必然会导致司法资源的市场化配置和运作,形成司法方法的制度性腐败.

Dissimilation of Legal Methods and Its Cause of Formation--An analysis of marketised distribution of judicial resources in judicial process

Legal methods in judicial processes are theoretical summary gained on the basis of judicial practice ,but not conclusion drawn from law theories alone. The writers query the view in law theory circles that legal methods are bound to have the attribute of rightness ,originally bring up the dissimilation of legal methods in judicial practice, and analyze its basic forms and its cause of formation .Moreover, from the angle of social information economics ,they expound and prove the dialectical relations between the dissimilation of legal methods and deals in judicial resources, showing that their interdependence, mutual transformation and mutual promotion will inevitably bring about marketised distribution and motion of judicial resources ,and then result in method-caused corruption of judicial activity system.
