| 摘 要： | 我国传统刑法价值取向植根于封建思想的土壤,在经济、社会结构发生根本改变的今天,已经落后于时代的发展。现代刑法取向必须摆脱这种束缚,植根于当代社会、经济基础,适应全球化发展进程,构建现代文明的基石。
