| 摘 要： | 承认行政法的不成文渊源是西方法治发达国家的共同选择。在行政法中引入不成文渊源能够有效克服成文行政法律规范的局限,主动应对行政裁量日益扩展的挑战,积极推动行政法规则的自我更新。我国行政法目前应当优先承认判例和政策的不成文法源地位。
