| 摘 要： | 交通事故认定不仅关系到民事赔偿份额,更关系到刑法上罪与非罪的认定,因此具有重要意义。交通事故认定书作为准鉴定结论类证据,在认定程序上存在弊端。因此,应当变革与完善我国的交通事故认定程序,从而确保事故认定结论的权威性。

| Abstract: | The responsibility identification in traffic accidents bears much importance since it is related not only to the share of civil compensation,but also to the identification of guilt or guiltlessness.The appraisal statement of accidents,as a quasi-conclusive type of evidence,has procedural defects.Therefore,we should change and improve the procedures of traffic accident identification to ensure the authority of accident conclusions. |
