| 摘 要： | 电子合同效力的安全性问题是阻碍电子商务发展的最大问题,实践证明,纯技术性的防范手段不能对各种恶意攻击和网络犯罪起永久性的制约作用,只有法律和技术双管齐下,才能维护和保障电子商务的稳健发展.以我国<电子签名法>以及<电子认证服务管理办法>正式实施为背景,就认证机构在电子商务安全交易过程中所处的地位、发展现状、制度完善等问题作理论上的探讨,为电子商务有序、有效、安全、顺利地发展提供前提和基础.

| Abstract: | The biggest problem which obstructs the development of E-business is the security of E-contract's effect.Proved by practices,the purely technical protective methods can not restrict all kinds of ill will attracts and web crime permanently.Only by using the laws and techniques atogether can protect and ensure the steady development of E-business.Under the background that the 'E-signs Law' and the 'electronic authentication policing method' are put into effect officially,the theoretical discussion of the problems which include the status,the develop present situation and the improvement of mechanism of authentication institutions play in the E-business safe trade will provide the premise and foundation for E-business developing orderly,safely and smoothly. |
