| 摘 要： | 作为西方社会长期发展的产物,民主和宪政都被寄寓了人类对幸福的憧憬和期望,但各自又蕴涵着特有的价值理念和人文关怀.相对于个人权利和自由而言,民主与宪政都只是手段,个人权利和自由才是目的.在制度层面,要建立健全民主宪政体制,应重塑"民主"与"宪政"的协调并用模式,扬弃单纯的民主和单纯的宪政的弊端.

| Abstract: | Arising from history of occidental society,democracy and constitutionalism embodied people's longing and expectation to happiness,while they have respective value conception and humanism thought.Democracy and constitutionalism are both method while individual right and liberty are correspondingly the objective.As viewed from the system level,a mode that har- monizes the democracy and constitutionatism should be reestablished and the disadvantages of simplex democracy or simple con- stitutionalism should be discarded to perfect the democratic constitutionalism system. |
