| 摘 要： | 《刑法修正案(九)》新设虚假诉讼罪,为进一步打击虚假诉讼行为提供了锐利武器。从司法实务看,追诉虚假诉讼罪,需要有相应技术指引。公安司法机关在证据运用时,既需要精细化的刑法解释,也受制于刑事诉讼程序结构,以及现行民事诉讼程序的具体运作。目前应当坚持在一般情况下,由公安机关对虚假诉讼罪行使立案侦查权;但其应进一步提升自身办案能力并加强相关制度建设;同时,在刑事立案条件的把握上,可以在一定程度上弱化"刑事责任"的意义,以破解该罪追诉程序之困。
