| 摘 要： | 内幕交易犯罪严重扰乱证券交易市场的正常秩序,对内幕交易的主体、内幕交易的主观方面和客观行为的认定,我国立法还存在着一定的疏漏和不完善的地方。对内幕交易的行为主体应增加相应的范围,泄露内幕信息罪主观方面可以由过失构成,内幕信息的知悉人建议他人买卖证券情节严重的行为应纳入刑法调整的范围。

| Abstract: | The crime of insider trading severely endangers the normal order of the securities exchange market.As to the affirmation of the sub ject,subjective aspect and objective act of this crime,our legislation still nee ds to be improved and perfected.The range of the sub-ject of the act of insider trading should be enlarged,and criminal negligence may also constitute the subj ective aspects of this crime.The serious act of the insiders' advising others to buy and sell securities should be brought into the regulation range of the crim inal law. |
