公安机关视野下缓刑的适用与执行

早已为世界各国广泛采用的缓刑，在我国当前却呈现出适用不当的态势。这不仅与制度层面的立法规定有关，而且与司法实践中的诸多现实因素相联。在现有框架下，公安机关应做好人身危险性评价的调查，建立案件的追踪制度，完善执行中的考察，注重运用建议撤销权，以遏制缓刑的不当适用。
