| 摘 要： | 居正是中国近代有重要影响的法律家,其从中国富强民主的目标出发,形成了内涵丰富的法律思想。孙中山的三民主义构成其法律思想的最高指导原则,“厉行法治”“、司法党化”“、以德辅法”以及“混合法”等四个方面构成了居正法律思想的主干。尤其是他的“混合法”思想具有明显的时代特色。居正的法律思想不仅推动了中国近代的法律进步,对于当代社会也不无裨益。
