| 摘 要： | 诉讼效益是通过诉讼活动所实现的社会效果与诉讼目的之间的重合程度。目前诉讼制度及运作有其不合理性和弊病。实施ADR(替代性纠纷解决机制)可在一定程度上分流一部分诉讼,缓解司法压力,避免诉讼机能障碍和诉讼效益的降低,从而有助于诉讼制度本身效益的发挥和提高。

| Abstract: | The effectiveness of lawsuit is the combination between the social effectiveness and the goal of the lawsuit. Currently, some long-standing irregularities exist in the lawsuit. ADR can settle some of the lawsuits in some degree to lessen the pressure on jury to avoid obstacles and decrease of lawsuit effectiveness so as to improve the effectiveness of the lawsuit. |
