论宪法宣誓制度的中国构建

党的十八届四中全会决定要求建立宪法宣誓制度,宪法宣誓制度作为世界普遍确认的宪政制度,具有丰富的域外经验和中国实践。宪法宣誓制度的中国构建的理论基础在于宪法授权理论和人民主权理论,实践基础在于尊重宪法的需要和坚持依宪治国。宪法宣誓制度兼具仪式化和法律化双重功能。当务之急是要精心设计、规范构建出中国特色的宪法宣誓制度。
