| 摘 要： | 我国国家赔偿法规定行政赔偿范围包括国家承担赔偿责任的行为范围和侵权损害范围。行政赔偿职务行为范围主要包括违法拘留或违法限制公民人身自由、非法限制或剥夺公民人身自由、暴力行为、不作为等;行政侵权损害范围包括财产损害和非财产损害。其中,国家对行政侵权精神损害也应当予以适当赔偿。

| Abstract: | According to state indemnity law,governmental compensation includes the scope of state assuming compensation for responsible doings and the scope of administrative infringement damage.The limit of official conduct of governmental compensation mainly covers detention or confining citizen personal liberty against law,illegal confining or depriving citizen personal freedom,violent action,undutifulness etc;the limit of administrative infringement damage consists of propertied damage and non-propertied damage.Among them,state also should give the appropriate indemnification for spiritual injury caused by administrative infringement. |
