科学与诠释:法哲学研究的两种理路

法哲学研究经历了神学取向、科学取向和诠释学取向这样三个阶段。这三个阶段是历时性的纵向发展过程 ,但也不排除共时性的存在。在当今 ,神学取向的法哲学研究已衰微 ,而科学取向和诠释学取向已成为法哲学研究的两种理路。虽然哲学诠释学是在反对“科学方法”的名义下产生的 ,但它与科学方向之间并没有一刀两断 ,相反 ,二者之间的相互渗透却越来越多 ,它们构成了人类思维和认知之两翼。

Science and Interpretation: Two Methods of Legal Philosophy Research

The legal philosophy research undergoes three periods of theology, science and interpretation orientations. At present, after the legal philosophy research of theology orientation has declined, the science orientation and interpretation orientation have become two methods of legal philosophy research. Although philosophy interpretation is contradicted with science orientation, they permeate each other and constitute the two wings of human thinking and understanding.
