死刑当废？——从刑罚的目的分析死刑的存废根据

死刑存与废是刑法学界争议不休的问题。本文认为刑法的目的是保护社会,刑罚的目的是在保护犯罪人在内的全部公民基本人权,刑罚的适用对象主要是社会上具有中间状态的一般潜在犯罪人和理智型的罪犯。死刑废除与存在的根据就只能是根据刑罚的适用对象的特点,决定了死刑在条件成熟的时候应该废除,但现阶段中国还不能废除。

Should the Death Penalty Be Abolished? -- Analyze the Basis of the Preservation and Abolition of Death Penalty from the Purpose of the Penalty

This thesis considers that the purpose of criminal law is to protect society, and the purpose of the penalty is to protect all human basic rights with the crime person inside. The penalty is mainly applied to the general and latent crime person of the appearance of middle and rational type in the society. The abrogation and existent of death penalty is mainly decided by the characteristics of the object to whom the penalty is applied, so, the death penalty should be abolished in the time when the condition is mature, but at present stage China can't abolished it.
