| 摘 要： | 传统行政主体理论认为非行政机关只有在法律、法规授权的情况下，才具有行政主体地位的观点有失偏颇。随着现代行政法疆域从国家行政扩展到包含公共行政和社会行政，只要村民委员会履行公共管理职能即应确立其当然的行政主体地位。

| Abstract: | The traditional theory about administrative subject which believes that the villagers' committee could be administrative subject according to the traditional administrative laws,according to the development of public and social administration,the villagers' committee could be administrative subject so long as it use public power to manage public affairs..in addition,the dissertation also proposes the corresponding measures for the perfecting of administrative subject of the villagers' committee in our country. |
