| 摘 要： | 罪犯劳动报酬权是参加劳动的罪犯的一项重要权利，也是罪犯人权的重要保障。罪犯劳动报酬制度肯定了罪犯劳动的自身价值，是监狱日益走向文明的标志。《中华人民共和国监狱法》第72条有关罪犯劳动报酬的规定中，罪犯劳动报酬的产生、罪犯劳动报酬的标准有其理论依据；比较国外罪犯劳动报酬制度，借鉴国外罪犯劳动报酬的理念，结合我国的国情，以建构我国罪犯劳动报酬制度。
