| 摘 要： | 对于“婚内强奸”行为是否应当被认定为强奸罪的问题,任何极端化的观点都是不妥当的。在严格的特定条件下,即妻子确有拒绝与丈夫性交的正当理由,而丈夫强行为之,并且造成严重后果的,应当以强奸罪论处。

| Abstract: | Whether the rapes behavior inside of the married should or not be affirmed of the rape, any extremity standpoint is inappropriate. Under the strictly particular term, if the wife does have proper reason to refuse having sexual intercourse with her husband, the husband forces her to sex, and lead to a serious result, he should be punished for the rape crime. |
