| 摘 要： | 目前,我国实行"宽严相济"的刑事政策,而西方国家实行"轻轻重重"的刑事政策.这两种刑事政策的产生都是由于面临高涨的犯罪现象.不同于西方已经实现了轻缓化的刑罚结构,我国的刑罚基本上处于"公正刑"阶段,已没有加重的余地.面对高涨的犯罪现象,我国应实行"稳中趋宽"的刑事政策.
