保险代位求偿制度前行路径探析——基于法律保护的视角

新《保险法》加大了对被保险人的权益保护力度,但对代位求偿权保护的规定仍显粗略,导致实践中代位求偿效果差。代位求偿权的法律保护比其行使更为重要,但法律是间接通过对被保险人的规范和制约来实现对保险人代位求偿权的法律保护。目前存在争议的是被保险人对第三者责任弃权行为的效力、被保险人提供协助义务的形式及范围、代位求偿权的存在价值。面对未来,我们应构建中国法下的保险代位求偿保护制度。

Exploration of Insurance Subrogation System＇s Future——Based on the perspective of legal protection

The new Insurance Law has increased the protection of the Insured rights;however,the protection of the right of subrogation provisions remained rough,led to the poor practice of subrogation.The legal protection of subrogation of is more important than its exercise,to realize the right of legal protection of the insurer＇s subrogation,the law is indirectly regulate and restrict the insured person.The current disputation is effects of the insured give up the third party＇s responsibility,The form and scope of the obligation to provide assistance to the insured,the value of the existence of the subrogation system.In the future,we should build the insurance subrogation system under China＇s law system.
