| 摘 要： | 刑事责任必须具有合理的根据，否则刑事责任的追究是不合理、不正义的。合理、正义的刑事责任根据应该是一个包括哲学根据、实质根据、法律根据和事实根据四个层次的立体组合。从事实根据到哲学根据是一个由表及里的递进过程，也是一个由感性认识到理性认识的过程。
