| 摘 要： | 社会保险是事关民生的重大制度安排。面对我国社会保险制度改革前所未有的新形势、新课题和新考验,社会保险立法应当秉承新的立法理念,承载新的历史使命。其中,坚持《社会保险法》是劳动者的权益法和福利法,建立与时俱进的发展型社会保险制度,重构国家在社会保险中的角色与义务,推动新型劳资关系与社会主义和谐社会的建设,是社会保险立法应当解决的核心问题。

| Abstract: | Social insurance is a significant system arrangement that is in close connection with the people＇s livelihood.Confronted with the new situation,new subject and new test that Chinese social insurance system has never encountered,the social insurance legislation should hold new legislative ideas and carry the new historic mission.Sticking to the idea that social insurance law is the right and welfare law of laborers,establishing the social insurance institution that develops with time,reconstructing the role and task of the state in social insurance,promoting the construction of new labor-capital relationship and socialist harmonious society are the core problems that social insurance legislation should deal with. |
