在自治与自主之间——论我国大学章程的价值追求

对于应然价值追求和实然价值追求的混淆是我国当前大学章程难产的重要原因。在现行的制度环境下,我国难以实现西方意义上的、完全的大学自治,因此应当将"自治"作为应然的、终极的价值追求,而把法律规范和政策文件中明确承认的"自主"作为实然的、务实的价值追求,从而以应然和实然的二元划分的逻辑为起点构建具有中国特色的现代大学制度。

Because of the confusion of the ought to be value pursuit and the ralisitc one,the university charters are facing huge difficulties.In the environment of active systems,it is hard to realize the complete autonomy of universities just as the western ones.It is wise for us to regard autonomy as the ought to be and the ultimate value pursuit,and regard the self-government,which is definitely validated by acts and policies,as the realistic and pressing value pursuit.As a rational choice,the dualism of the ought to be and the realistic is the logic jumping-off point to construct the modern university system with Chinese characteristic.
