| 摘 要： | 丢失枪支不报罪的危害行为是过失导致枪支丢失,而不是丢失枪支后不及时报告;不及时报告与严重后果之间并不具有刑法上的因果关系,它既不是危害行为也不是危害结果,而只是一种限制处罚范围之要素;判断是否“及时报告”应着眼于客观上是否在危害后果发生之前的合理时间内报告,而与行为人何时明知或应知枪支丢失没有关系。

| Abstract: | The harmful action of crimes of losing gun and failing to report in time is losing gun which caused by negligence,not failing to report in time.Failing to report in time is only a factor of to restrict punishment scope,for there is not a criminal causality between it and the serious consequences and it is not a kind of harmful action or consequence.When judge "in time" or not,we should pay attention to whether the actor reported in reasonable time before the serious consequences,not the time of the actor that know the gun's losing. |
