| 摘 要： | 未遂犯作为一种危险犯,虽然不需要以实害结果作为犯罪的构成要件,但却具备以“行为无价值”为内涵的完整的犯罪构成。处罚未遂犯是立法上基于“行为无价值”的评价之必然结果。

| Abstract: | As for the attempt crime is a kind of dangerous crime,the conditions of the constitution of the crime would not require for the actual results.However,the attempt crime has its own constitution based on the value of behavior science.On account of the science of behavior without value,it is the inevitable result for the legislation to punish the attempt criminal. |
