| 摘 要： | 侵犯著作权的刑事法律救济是著作权保护中的一个薄弱环节,其根源在于刑法保护著作权的执法环境不尽如人意。具体表现为著作权人自身的维权意识不到位及社会的著作权保护意识淡薄,与刑事法律救济的间接性、著作财产权的特殊性也不无关系。在中国入世的今天,加强侵犯著作权的刑事法律救济是著作权保护的一个不容忽视的重要课题。

| Abstract: | The author reveals the weak point in the copyright protection, i. e. , the criminal and legal succor when the copyright is infringed upon, the reason of which is the fact that the environment of copyright protection is not satisfying, which shows in the following aspects: the copyright owners and the whole society fail to be aware of rights defense; the indirectness of the criminal and legal succor and the characteristics of the copyright itself. In today's China, to reinforce the criminal and legal succor is an important subject that must not be neglected in the copyright protection. |
