| 摘 要： | 现代行政的服务型特质已使政府的身份从传统管理者向服务者的方向转变,行政给付成为服务型政府的重要职能。当代社会法律保留不再是侵害行政领域的"专利",其已在给付行政领域发挥重要影响。中国明确提出"全面推进依法治国"、"加快建设服务型政府",这将促使法律保留原则在我国现有法律体系,特别是给付行政规范领域进一步适用,筑牢服务型政府建设的法制基础。
