论个人住房抵押贷款中抵押权的实现

摘    要:个人住房抵押权的实现是住房抵押权制度的核心问题。目前 ,个人住房抵押权的实现存在以下三个方面的问题 :一是实现手段单一 ;二是程序繁琐 ;三是社会保障体系落后。为使个人住房抵押权得以实现应从四个方面对抵押权的实现方式进行变革 :一是丰富实现手段 ;二是改革拍卖方式 ;三是完善社会保障体系 ;四是实现抵押权的流通化。

Abstract:Implementing the hypothecating right of personal housing is the core of the system of hypothecating rights.At present,there lie three problems in the process of implementing the hypothecating right of personal housing:single mean,overelaborated procedures and backward social security system.It is necessary to reform this condition.The countermeasures are:to enrich the implementing means;to reform the auction modes;to improve the social security system and to realize the circulation of hypothecating right.
