| 摘 要： | 周村的司法实践表明,乡土社会交往的基础是关系网络与生存结构。利益已经成为影响人们构建和维持关系的主要因素。当今的中国村庄面临着两种利益与价值共生的局面。乡土正义就是在这两种利益与价值之间寻求平衡与调和,这不同于西方价值体系中的正义观。

| Abstract: | Judicial practice in Zhoucun shows that rural social interactions are based on interpersonal guanxi network and survival structure. Interests have become the main factors to build the maintain relations. Villages in China today are facing two kinds of interests and values. Rural justice need balance and reconcile these two kinds of interests and values, and it is different from the Western conception of justice in judicial value system. |
