| 摘 要： | 法治国家的原则与法治国家建设的任务须为具体行动,在刑事法领域要贯彻法治原则就要化为坚持罪刑法定原则,罪刑法定是刑事法领域的法治原则.罪刑法定及刑事政策的相关方面,如罪刑法定机能及其演变、刑事政策的内涵、罪刑法定和刑事政策的紧张性及其调和,当前刑事政策中的热点问题以及刑罚反制犯罪关系等问题值得思考.
