论我国网络犯罪的立法完善

网络犯罪作为与高科技相伴生的新型犯罪,对我国刑事法律中关于网络犯罪的罪名问题、刑罚问题、犯罪构成问题、刑事诉讼制度等产生了诸多冲击。针对我国网络犯罪刑事立法的不足之处,应当确定网络犯罪含义,选择恰当立法模式,增加刑罚种类,推进量刑适当,完善网络犯罪构成,从而完善我国网络犯罪刑事立法。

On the Legislative Perfection of Our Country's Cyber Crime

Cyber crime,a new type of crime emerging from and accompanying with high technology,has produced many impacts to legislative question of charge,penalty question,constitutive elements of crime question,criminal suit system about the crime of the network in the criminal law of our country.In view of drawback in our courtry's criminal legislation on cyber crime,we should make sure the meaning of cyber crime,choose proper legislative mode,increase penalty type,advance proper weighing of penalty,perfect the constitution of cyber crime in order to improve our country's criminal legislation on cyber crime.
