中国区际侦查合作若干问题研究

区际侦查合作是中国区际司法协助的基本形式。产生于特殊历史时期,由基本法作出原则规定,没有上位法的协调是其重要特征。实践中,警方对普通刑事案件的联手侦查和廉政机关对职务犯罪的个案协查成效显著。合作应在“一国两制”、相互尊重、以程序为主、效率优先等原则的指导下进行。针对缺乏法律调整的现状,亟待各法域协商制订区际司法协助规范,加大追逃追赃力度,采取水上联合围捕行动,使用特殊侦察手段来有效遏制此类犯罪的发展与蔓延。

Research on Several Questions of Interregional Investigative Cooperation in China

Interregional investigative cooperation is a basic pattern of interregional judicial cooperation in China.It came into beings in a particular history period,was stipulated in principle by basic law when there was no upper law for regulation.In practice,police achieve remarkable success in joint investigation of ordinal criminal cases,and in the cooperative investigation on individual cases with the incorruptible politics organs to fight against corruption.Cooperation should be conducted under the instruction of such principles as"One country,two systems","Respecting each other","Regarding procedure as the majority"and"Efficiency is the priority".In accordance with the current situation of lacking law adjustment,we expect to consult and formulate regional judicial assistance regulations,to strengthen its capabilities in pursuing the escaped criminals and in recovering stolen money and goods,to take combined besiege acts on seas and to use special reconnaissance means in order to keep within limits the development and spreading of this kind of crime effectively.
