| 摘 要： | 宽严相济政策的着眼点是从宽。全世界范围内的刑罚改革发展趋势，是逐渐呈现轻刑化的特征。“盛世轻刑罚”从客观上要求刑事政策侧重于从宽。刑事政策要坚持人道主义，立足于从宽处罚的主观维度分析，在审慎关注导致犯罪人犯罪的客观因素的同时．要特别高度重视导致犯罪人犯罪的主观因素，对于犯罪动机与目的、实施犯罪行为及产生结果所表露的思想和意图、犯罪后的态度及为补救损害所做的努力等犯罪人主观方面的情节认定，都会影响到从宽政策的贯彻与实行。
