| 摘 要： | 出租车经营中存在的垄断问题，包括：出租车公司与交通主管部门之间存在政企同盟、出租车公司滥用市场支配地位和形成垄断协议、自由资本对低效管制体制的冲击等。解决问题的路径除了现实主导的行政力量外，还可以有反垄断执法机构的执法、法院的反垄断司法。

| Abstract: | Taking the strike of taxi drivers in 2008 as a starting point, this paper regards the industry of taxi as a natural monopolized industry and the service of taxi as a quasi public product and points out the problems in the management of taxis. These problems include the alliance of enterprise and administration between taxi compa- nies and competent authorities of transport and communications, the abuse of market domination position to form monopoly treaty and the impact of free capital to low - efficient management mechanism. In addition to the leading administrative power, the ways out can be found in the law enforcement of anti - monopoly organs and anti - mo- nopoly law in the court |
