| 摘 要： | 扫黑除恶专项斗争是着眼于社会繁荣稳定、国家综合治理的全局性部署,体现了国家严惩基层黑恶势力的决心和态度。刑法作为保障国家、社会和公民权益的最后防线,有必要对严重妨害社会管理秩序、危害公众生命财产安全的黑恶势力犯罪做出及时应对。但刑法自身的谦抑属性强调其参与扫黑除恶进程的理性与克制。为此,需要在客观分析黑恶势力犯罪惩治现状的基础上,论证刑法介入扫黑除恶专项斗争的必要性与限度性,并从准确把握法律政策界限、逐步完善刑事法网、加强部门联动合作和加强群众参与监督等方面探索推进扫黑除恶专项斗争的法治路径。
