| 摘 要： | 知识产人权侵权损害赔偿问题比有体财产复杂得多,我国现行立法规定带有片面性,且可操作性差,急待完善。为此,建议我国立法一方面在赔偿范围方面应遵循全部赔偿原则,另一方面建立法定赔偿金制度和惩罚性赔偿制度,以充分保护知识产权人的合法权益。

| Abstract: | The problem of damage to knowledge property is much more complicate than that of substantial properties,however,concerning this aspect,the correlated laws have unilateralism in concrete regulations and their maneuverability is not strong. The system demands to be perfected urgently. Therefore,we should abide the principle of overall compensation in the range of compensation; on the other hand,we should set up the system of damages by law and the system of penal compensation in order to protect the lawful rights of knowledge properties owners. |
