| 摘 要： | 在我国目前的司法实践中,拘传基本不用,监视居住采用率低,刑事拘留采用较多,逮捕大量采用,取保候审检察机关较公安机关采用较多。从立法到司法实践,强制措施都存在问题。完善刑事强制措施立法,要坚持功能实现原则、必要性原则和适度原则,从体系上、整体上、个体上全面进行。

| Abstract: | In our present justice practice,issue a warrant is hardly used;surveillance residence is used less than criminal Detention;arrest is used in high frequency,at the same time,release on bail is used more frequently in procuratorate than public security organs.There are some problems aroused in criminal compulsion measure from the regulation to justice practice.In order to perfect the criminal compulsion measure,it is necessary to insist the rule of function implement,the rule of necessary and the rule of moderation. |
