论犯罪构成与犯罪形态的关系

犯罪的未完成形态与(狭义)共犯形态所具有的是否就是所谓修正的犯罪构成,一直是中国刑法学中存在争议的问题.立于刑事责任与犯罪构成的关系、犯罪形态与犯罪成立的关系以及犯罪的未完成形态与(狭义)共犯形态的社会危害性或法益侵害性,则犯罪的未完成形态与(狭义)共犯形态所具有的仍是完整的犯罪构成.进而,犯罪构成与犯罪形态的关系便可得到进一步的揭示:犯罪构成是犯罪形态的“筋骨”,而犯罪形态则是犯罪构成的“载体”.至于特殊犯罪形态的构成条件问题,似可形成其他具有针对性的刑法学概念.
