食品安全犯罪立法修正之评析及其再完善——以《刑法修正案(八)》为样本

《刑法修正案(八)》一方面对食品安全犯罪的犯罪对象、罚金刑、自由刑进行了修改,另一方面,增加犯罪情节要件和增设食品监管渎职罪,从而加大了对食品安全犯罪的惩处力度,使得刑法对食品安全的保护更为严密和全面。我国当前的食品安全形势、原有食品安全犯罪之规定存在的不足以及监管对食品安全的重要性,决定了本次食品安全犯罪立法修正的合理性。在司法中,需要对食品安全标准、罚金刑数额及其计算标准和食品安全犯罪情节进行重新解释。同时,考虑到食品安全犯罪危害的特点和国外相关立法例,应从增设行为犯、过失犯和资格刑等方面进一步完善我国的食品安全犯罪立法。

Comments and Further Improvement of the Legislative Amendmentson FoodSafety Crime——With Criminal Law Amendment 8 as the sample

Criminal LawAmendment 8 amended the object of the crime,pecuniary penalty and punishment against the freedom of food safety crime.In addition,it increased the elements of criminal plots and added the crime of food supervision malfeasance,which reinforces the punishment of food safety crime and makes the protection of food safety more closely and comprehensively.China’s current food security situation,the shortage of the existing food safety and the importance of supervision on food safety,determine the rationality of the amendment on food safety crime.In the administration of justice,we need to reexplain the food safety standards,the volume with the calculation standard of pecuniary penalty and the elements of criminal plots of food safety crime.At the same time,taking the characteristics of the harm of food safety crime and the legislation of foreign countries into consideration,we should add the conduct crime,the negligent crime and the penalty of qualifications to the food safety crime to further improve the legislation of China’s food safety crime.
