| 摘 要： | 在村民自治中实现对权利的司法救济具有重要的作用,然而,我国村民自治中权利的司法救济却面临困境,一方面是村民自治中权利的非司法救济途径表现出各种缺陷和局限性,另一方面是司法救济途径的尴尬和无可奈何。为此,必须构建我国村民自治中权利的司法救济制度,以保障村民自治中各项权利的实现和村民自治的健康发展。

| Abstract: | The infringement of rights in the process of villager's self-governance has been a widespread problem and brought about the harmful consequences in our country.At the same time the non-judicial remedy of rights contains lots of serious flaws.Therefore,it is very important to construct the judicial remedy system of rights in the process of villager's self-governance so as to ensure the realization of various rights,avoid the power abuse,enhance the awareness of the law,and foster the law-abiding habit. |
