论法治理念

法治理念是对法律本质及其发展规律的一种宏观的、整体的理性认知、把握和建构,是法律实践中对法律精神的理解和对法的价值的解读而形成的一种理性的观念模式。其中法律权威理念和权力制约理念是法治理念的灵魂,人权保障理念是法治理念的根本宗旨,而和谐司法理念是法治理念的实现形式,四者结合构成了完整的法治理念形态。

On Ideas of Rule of Law

Ideas of rule of law is a kind of acknowledgement about the essence and disciplines of law and its development,and are a series of conceptional patterns about the understanding of spirits and values of law.Among them,the idea of authority of law and the idea of power restric- tion are the soul of ideas of rule of law,the idea of human rights protection is the ultimate tenet of ideas of rule of law,the idea of harmonic justice is an approach to realize ideas of rule of law, all of them make up of a completely conceptional form of ideas of rule of law.
