论国际刑事法院对恐怖主义犯罪的管辖权

国家安全近年来受到恐怖主义的严重威胁,采用传统的军事打击方法不能完全解决问题。因此,国际社会一直希望能在国际法律层面对恐怖主义犯罪进行管辖、审判与惩治。《罗马规约》明确规定了国际刑事法院对灭绝种族罪、危害人类罪、战争罪和侵略罪的管辖权,但没有具体规定对恐怖主义罪的管辖权。把恐怖主义罪作为一个罪名纳入国际刑事法院的管辖范围,将在法律上有效地打击恐怖主义犯罪,从而最大限度地缩小恐怖主义对国家安全的威胁。

On the International Criminal Court's Jurisdiction on the Crime of Terrorism

National security is suffering serious threats of terrorism.International community and want to dominate and publish the crime of terrorism on international law dimension since traditional means of military attack didn't resolve this problem entirely.According to "the Rome Statute" of the International Criminal Court,the ICC has jurisdiction on genocide,crimes against humanity,war crimes,and the crime of aggression.But "the Roma Statute" does not include the crime of terrorism.However,some acts of terrorism can be characterized as crimes against humanity.Therefore,the ICC could assert jurisdiction over these acts of terrorism.On the 2009 Review Conference,the crime of terrorism may be included in the Rome Statute as one of the crimes against humanity.It will attack the terrorism crime more efficient in law and alleviate the threat of terrorism to national security to the greatest extent.
