| 摘 要： | 初查是司法实践界对立案前审查的俗称。由于法律规定的缺失与矛盾,实践界与理论界对初查的法律地位、行为性质、法律后果等有很大的争议。根据初查现状的矛盾,应明确立案前审查行为的内容和手段,规定立案前审查的时限,明确立案前审查的监督。

| Abstract: | Preliminary investigation is a common name in judicial practice circle for the examination before a case is placed on file. Because of the imperfection and contradiction of some legal stipulations, the practical and theoretical circles have great disputes over the preliminary investigation's legal position, nature of the act, legal consequences, etc. This paper discusses that, in order to solve the presently existing contradictions in preliminary investigation, we should clearly define the contents and measures of this act, stipulate the time limit, and establish the supervision on it. |
