| 摘 要： | 在我国未来民法典中,动产所有权取得时效的构成要件应包括两个方面:占有和经过法定的期间.至于善意占有则不是动产所有权取得时效的构成要件,但对善意占有,应规定较短的时效期间.

| Abstract: | In the future civil code of our country,the constitutive requirements of chattel ownership should include two aspects: occupancy and "through legal period".As for the bona fide possession,it isn't the constitutive requirements of chattel ownership,yet should be given shorter limitation period. |
