| 摘 要： | 在城市房屋拆迁当中,程序规则能够弥补实体规则之不足,解决实体法所难以解决的一系列问题,如对于“公共利益”的界定、对拆迁中的权力(利)体系的整合、对拆迁中的法律关系的澄清以及对于拆迁补偿的规则的制定等,程序都发挥着重要的动态功能,这将有效地指导我国的相关立法活动逐步走向成熟。

| Abstract: | In urban house demolition,the rule of due process can make up the deficiency of the rule of entity,it can figure out a series of questions that rule of entity cant solve.Due process will play a very important role in defining "public interests",conforming the system of powers(or rights) in urban house demolition,clarifying the relation of law in urban house demolition and establishing rules about compensation caused by urban house demolition etc,which will make our lagislation get on the way to perfection. |
