信托定义:英国法学界的研究述评——有关学者对信托定义思维模式的秉持及其检讨

由英国学者分别在四个世纪的时间跨度内先后提出的重要的或者具有显著的学术影响的六项信托定义和对它们的评析以及三项信托定义设计方案,都是由其通过对关于信托定义的法律态度揭示导向思维模式的秉持构思其内容。但这些学者“前赴后继”地想构思出“一项令人完全满意的信托定义”至今还没有取得成功。故有关学者分别提出了三种信托定义替代方案,但其中有两种也是由其通过对关于前述思维模式构思其内容。将前述思维模式作为信托定义思维模式并不恰当。只要有关学者在今后改为秉持关于信托定义的信托本质属性揭示导向思维模式来构思其内容,由其提出的信托定义便极有可能成为“一项令人完全满意的信托定义”。
