刑事财产查控机制研究

摘    要:依靠犯罪分子及其家属主动履行财产刑难以保证刑罚执行效果。执行机关掌握执行主动权,有效查控犯罪分子合法财产是财产刑执行到位的最后保障。传统的财产查控方式效率低下,无法满足现实需要。借助现代信息网络技术以及大数据、云计算、人工智能等高科技手段,法院系统建立起了网络查控系统,提高了查控质效。但目前财产查控机制仍然存在审前财产查控正当程序缺失、机构协助的工作机制缺失以及财产查控方式局限等问题。要改善财产查控困境,应当完善保障财产刑执行财产查控法律程序、确立相关机关的协作机制以及创新财产查控技术和方式。

Abstract:It is difficult to ensure the effect of criminal punishment by relying on criminals and their families to fulfill property punishment voluntarily.Executive organ holds executive initiative,effective check and control criminal lawful property is the final safeguard that property penalty executes in place.Traditional methods of property inspection and control are inefficient and cannot meet the practical needs.With the help of modern information network technology,big data,cloud computing,artificial intelligence and other high-tech means,the court system has established a network inspection and control system,which has improved the quality and efficiency of inspection and control.However,there are still some problems in the mechanism of property inspection and control,such as the lack of due process,the lack of institutional assistance and the limitation of the way of property inspection and control.To improve the dilemma of property inspection and control,it is necessary to perfect the legal procedure to guarantee the execution of property punishment,establish the cooperation mechanism of relevant organs and innovate the technology and methods of property inspection and control.
