| 摘 要： | 以胡锦涛为总书记的党中央领导集体提出:构建社会主义和谐社会要坚持科学发展观、以人为本。这对我国当代建设中国特色社会主义的各项事业,具有普遍的指导意义。它要求现阶段我国的法理学、法学研究,也应以"以人为本、尊重和保障人权的范式"代替"以阶级斗争为纲的范式"。"以人为本、尊重和保障人权的范式"要求发挥法在实现和维护社会公认的公平公正、协调社会矛盾和解决纠纷及对弱势群体的特别关注等方面的价值和功能。

| Abstract: | The leaders of CCP bring forward the notion of scientific development and human-orientation,which has a nature of philosophical guidance,and supply an new paradigm on socialist-legal construction,and requires that China's ligal and jurisprudential research should replace the paradigm of class-struggle by paradigm of respecting and recognizing human rights.The paradigm of respecting and recognizing human rights requests us to exert the value and function of law on realization of social and legal justice,coordinating social contradiction and dispute-resolution,and placing an special attention on social-inferior class. |
